determine whether or not an alien described under subparagraph (B) or (C)
has a conviction for any criminal offense;
‘‘(ii) identify each victim of a crime
for which an alien determined to be a
criminal under clause (i) has a conviction;
‘‘(iii) provide each victim identified
under clause (ii) with actual notice that
the alien is being considered for a waiver
under this paragraph;
consult with each victim identi-
fied under clause (ii) to determine whether
or not the Secretary should, in the case of
an alien who is determined to have a con-
viction for any criminal offense under
clause (i), exercise waiver authority for an
alien described under subparagraph (B), or
grant the application of an alien described
under subparagraph (C); and
‘‘(v) if the Secretary exercises waiver
authority for an alien described under sub-
paragraph (B), or grants the application of
an alien described under subparagraph
where the alien has a conviction for
any criminal offense, provide each victim
identified under clause (ii) with actual no-
tice that such waiver authority has been
exercised or that such application has been
granted.
